Scott Holmes is a highly experienced construction and civil litigation attorney who serves as Managing Partner of Burgess Holmes and represents clients throughout Alabama and Mississippi.
An AV Preeminent-rated trial lawyer, Scott handles complex disputes with particular experience in construction and design professional defense, alongside a broader practice encompassing professional liability, transportation, catastrophic injury, insurance, and commercial litigation. Scott represents contractors, construction product manufacturers, architects, engineers, and other design and construction professionals in disputes involving construction defects, professional liability, catastrophic injuries, contractual issues, and other project-related claims. His experience includes securing summary judgment on all claims for a precast concrete foundation manufacturer in a construction defect action seeking more than $680,000, as well as obtaining favorable results in binding arbitration for construction professionals. He has also secured summary judgment in catastrophic injury matters arising from construction and workplace accidents.
Beyond construction, Scott maintains a diverse civil litigation practice involving trucking and transportation, wrongful death and personal injury, premises liability, insurance coverage and bad faith, breach of contract, employment, intellectual property, and other complex business disputes. His record includes a defense jury verdict in a trucking-related wrongful death case and summary judgment for a public utility in complex environmental litigation, removing the client from the case before a four-week trial that resulted in a $70 million verdict against the remaining defendants.
Scott brings a preparation-first philosophy to litigation, shaped in part by his earlier career as a high school football and basketball coach. He earned his law degree with Honors from the University of Alabama School of Law, where he was a Hugo Black Scholar and Senior Editor of the Alabama Law Review. His other law school leadership positions included Assistant Prosecutor for the University Honor Court and Lieutenant Governor for the American Bar Association’s Fifth Circuit.
Admitted to all state and federal courts in Alabama and Mississippi, Scott is a member of both state bars and the Birmingham Bar Association.
