Erica Ann Probst is a principal at Kemp, Schaeffer & Rowe Co., LPA in Columbus, Ohio, and an experienced litigator whose practice includes construction law alongside commercial and business litigation and employment matters. With more than two decades of experience representing businesses, employers, employees, and other commercial clients, she handles complex disputes involving contracts, construction projects, trade secrets, injunctions, and other business-related issues.

Erica’s construction work includes litigation and contract-related matters arising from active projects. She prepares mechanic’s liens and assists clients with contractual issues, and her experience includes helping clients address problems affecting project performance, such as replacing poorly performing subcontractors in order to keep construction work on schedule. Her broader commercial litigation background complements this work where construction matters involve contractual or business disputes.

An experienced advocate, Erica has represented clients in state and federal bench and jury trials, AAA and JAMS arbitrations, and hearings involving temporary restraining orders and injunctions. Her wider litigation practice encompasses employment and labor law, contract disputes, trade secret enforcement, towing regulation, probate litigation, and general civil matters. She also reviews contracts for businesses, employers, and employees and prepares commercial contracts, releases, severance agreements, and non-competition and non-solicitation agreements.

In addition to her litigation practice, Erica serves as a mediator in civil disputes. She brings more than two decades of experience participating in mediations and negotiating on behalf of clients to her work as a neutral. Before joining Kemp, Schaeffer & Rowe in 2002 and becoming a principal in 2010, Erica practiced at Bricker & Eckler LLP and served as a staff attorney to Judge Thomas F. Bryant of Ohio’s Third District Court of Appeals. She is admitted to practice in Ohio and Indiana.

Erica has been recognized by Super Lawyers for Business Litigation since 2016, following recognition as a Rising Star from 2009 through 2015. She earned her J.D. from Indiana University Maurer School of Law in 1999 and her B.A. in East Asian Languages and Culture and Political Science from Indiana University in 1996.

Kemp, Schaeffer & Rowe (KSR) advises builders, subcontractors, general contractors, developers, and property owners on construction matters ranging from project contracting to complex disputes. The firm’s attorneys assist with drafting, reviewing, and negotiating construction agreements, including straightforward building contracts, complex general contracting arrangements, and public entity construction contracts, with an emphasis on minimizing risk and supporting successful project completion.

The firm also advises contractors, suppliers, and property owners on mechanic’s liens, including compliance with strict notice and timing requirements, protecting lien rights, responding to liens, and securing their removal. When necessary, KSR represents clients in lien-related litigation.

When construction disputes arise, KSR combines detailed investigation with practical legal and industry knowledge to address complex issues involving multiple parties. The team represents clients in negotiations, arbitration, and litigation, pursuing efficient and effective resolutions to construction-related conflicts.

Founded in 1977, Kemp, Schaeffer & Rowe is an Ohio law firm with a broad-based practice serving individuals, families, and businesses across a range of legal needs. The firm was established on principles of service and integrity that continue to shape its approach today, with attorneys emphasizing personal attention, careful preparation, and legal strategies developed around the individual circumstances and objectives of each client.

KSR provides counsel across areas including family law, estate planning, probate and estate administration, business and corporate law, construction law, real estate, employment matters, and civil and commercial litigation. The breadth of the practice enables the firm to assist clients with both personal and business matters and to draw on experience across disciplines when legal issues overlap or become more complex.

The firm emphasizes listening closely to clients rather than relying on standardized solutions, recognizing that even similar legal matters can require substantially different approaches. Its attorneys combine detail-oriented preparation with committed advocacy, working to understand the facts and applicable law thoroughly while developing practical strategies designed to protect each client’s interests. This relationship-focused approach has remained central to Kemp, Schaeffer & Rowe throughout its nearly five decades of practice.

“Erica Ann Probst brings a practical, business-focused mindset to construction and commercial disputes, with more than two decades of experience guiding clients through complex litigation. Her ability to move between contract issues, project-performance problems, injunction work, and broader business disputes gives clients a well-rounded advocate who understands both the legal and operational pressures behind a matter.”
